The law of sedition and criminal libel has always been a source of controversy. This is because the law seeks to curb totalitarianism to a culture of human rights. The position and context shall be that of Kenya comparing both the pre-2010 and post 2010 regimes with the positions in other states in the commonwealth. It seeks to establish a standing position and possible recommendations. In the end, what is necessary is that there is a balance between the competing need to ensure reputation is safeguarded and the overriding objective to ensure that the right to freedom of expression is protected. This book seeks to address and highlight the situation in Kenya making reference to the pre- and postcolonial period.
